WHO SHOULD BE A FOX VIP? Someone who loves TV, especially FOX! Someone who is active in social networking. Someone who is outgoing and an influencer in the community. Someone willing to be on TV, host viewing parties and participate in FOX events. Someone who can be relied on to spread the word about every thing FOX has to offer! Participation in FOX VIP is strictly voluntary, and may be terminated by you or FOX Network or FOX 50 (WRAZ-TV) at any time for any reason.
You must be at least 18 years of age or older at time of video submission/application and a legal, permanent resident of the U.S. and one of these North Carolina counties: Chatham, Cumberland, Durham, Edgecombe, Franklin, Granville, Halifax, Harnett, Hoke, Johnston, Lee, Moore, Nash, Orange, Person, Sampson, Vance, Wake, Warren, Wayne or Wilson. Employees of FOX 50 (WRAZ-TV)/Capitol Broadcasting Company, Inc., and their immediate families are not eligible to participate.
HOW YOU APPLY TO BE A FOX VIP: Log onto www.FOX50.com and submit a video describing “why I love FOX!” and complete an electronic application form. The application submission period begins 11/30/10 and ends at 11:59pm on 12/19/10. Limit one (1) application/submission per person. DO NOT MAIL OR DROP-OFF VIDEOS! ALL SUBMISSIONS MUST BE MADE ONLINE AT WWW.FOX50.COM.
Uploaded videos MUST meet the following criteria: (1) In the video, you must explain “Why I love FOX!”. Display your enthusiasm and engaging personality in your submission. (2) Videos must be no longer than 10 minutes. (3) You may only contribute videos that you have filmed yourself or that you have all rights to transmit and license and which do not violate trademark, copyright, privacy or any other rights of any other person. (4) By submitting a video, you grant permission for FOX 50 (WRAZ-TV) to receive and display the video as described herein. (5) You may not contribute videos that contain expressions of hate, abuse, offensive images or conduct, obscenity or pornography; advertisement or logos; or any material that could give rise to any civil or criminal liability under applicable law or regulations. (6) You may not upload any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or this website. (7) By uploading a video, (a) you grant to www.FOX50.com and FOX 50 (WRAZ-TV)/Capitol Broadcasting Company Inc. a perpetual, non-exclusive, worldwide, royalty-free license to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute the video and any material included in such video on the Internet, on television, and in, on, or through all other media; (b) you certify that any person shown in the submitted video authorizes FOX 50 (WRAZ-TV)/Capitol Broadcasting Company Inc. to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute (“Use”) the video and any material included in such video on the Internet, on television, and in, on, or through all other media; (c) you agree to indemnify www.FOX50.com and FOX 50 (WRAZ-TV)/Capitol Broadcasting Company Inc. and its affiliates, directors, officers and employees and hold them harmless from any and all claims and expenses, including attorneys’ fees, arising from Use of the video and/or your failure to comply with these rules; and (d) you certify that any video you submit complies with the criteria listed above.
Any expenses you incur during the video production process are solely your responsibility. Only one (1) submission per person will be accepted; do not upload more than one (1) submission. Eligible submissions will be posted and available for viewing on www.FOX50.com. Videos may be edited in FOX 50 (WRAZ-TV)’s sole discretion. FOX 50 (WRAZ-TV) reserves the right to disqualify any participant who fails to follow the submission criteria or for any other violation of these terms and conditions, as determined in FOX 50’s (WRAZ-TV) sole discretion.
FOX 50 (WRAZ-TV) will not verify receipt of submissions. Submissions become property of FOX 50 (WRAZ-TV)/Capitol Broadcasting Company Inc. and will not be returned. Submissions that are incomplete, illegible or corrupted are void and ineligible and will not be accepted. FOX 50 (WRAZ-TV) is not responsible for submissions that are lost, late, misdirected, incomplete, incomprehensible, illegible, damaged, undeliverable or delayed. In the event of a dispute, electronic and e-mail submissions will be deemed to have been submitted by the authorized account holder of the e-mail address at the time of the submission. The authorized account holder is the person to whom the applicable internet service provider or other organization (such as a business or educational institution) has assigned the e-mail address.
HOW FOX VIP IS SELECTED: On or about 12/20/10, a panel of FOX 50 (WRAZ-TV) judges will select, from among all those who submitted videos by the deadline, one (1) person who, if eligible and approved by the FOX Network, will be offered the role of FOX VIP. Judges will select the FOX VIP based on the enthusiasm and engaging personality expressed in the video, their description of “why I love FOX!” and the criteria listed above. Selected person’s video and information will be sent to the FOX Network for final approval. If FOX Network does not approve, FOX 50 (WRAZ-TV) may, time permitting, select another person for approval by FOX according to the same criteria described herein. Selection of FOX VIP made by FOX 50 (WRAZ-TV), as approved by FOX Network, is final. By January 31, 2011, the selected FOX VIP, as approved by FOX Network, will receive at the US Mail or email address included with submission a welcome letter, program guidelines and program paperwork. FOX VIP’s name will also be posted on FOX 50 website by January 31, 2011. One (1) FOX VIP will be selected by FOX 50 (WRAZ-TV), with approval of FOX Network, in the Raleigh-Durham market. Other FOX VIPs will be selected by other FOX affiliate stations and/or the FOX Network in other markets.
WHAT YOU MAY RECEIVE AS FOX VIP/ODDS/ RESPONSIBILITIES OF FOX VIP: One (1) FOX VIP selected by FOX 50 (WRAZ-TV) and approved by FOX Network will be offered various incentives items. The exact nature of the incentives offered to the FOX VIP is not currently known but is expected to include: promotional merchandise (for example, t-shirt and/or jacket), exclusive FOX content and access to FOX shows and talent. FOX VIP will also be loaned a Flip Video camera for use in carrying out duties of FOX VIP; Flip Video must be returned to FOX Network and/or FOX 50 (WRAZ-TV) at the conclusion of FOX VIP’s tenure as FOX VIP. Total approximate retail value of the incentives offered to the FOX VIP will not exceed $599. Incentives will be offered from time to time during FOX VIP’s participation in FOX VIP program and on no particular schedule. There are no odds of being selected as the FOX VIP because selection does not depend on skill or chance; rather, selection depends on your enthusiasm and engaging personality as depicted in the submitted video, your description in submitted video of why you love FOX and compliance with other guidelines.
The FOX VIP program is a new project and it is as yet undetermined how long the selected FOX VIP will have the FOX VIP role. Participation in FOX VIP may be terminated by the selected FOX VIP or FOX Network or FOX 50 (WRAZ-TV)/Capitol Broadcasting Company Inc. at any time for any reason. To participate, the FOX VIP must be willing to appear on air as requested, host viewing parties and participate in FOX events and must stay engaged in the FOX VIP program, provide feedback on the program and share the materials and content provided to them, as requested. The FOX VIP is not an employee, agent or joint venturer of the FOX Network or FOX 50 (WRAZ-TV)/Capitol Broadcasting Company Inc. but undertakes the role of FOX VIP on a strictly voluntary basis.
Any and all program episodes and/or other materials provided by FOX Network to selected FOX VIP may only be used as indicated must not be reproduced, sold or otherwise distributed in any other manner or for any other purpose. If you are reviewing, commenting on or endorsing FOX programs, you must clearly identify your association with the FOX. For example: “As a member of FOX VIP, I just received a free ________.” You must not use social media for covert marketing or public relations. If a member of the media contacts you through a social media website requesting FOX information of any kind, you must not respond to the media inquiry yourself, but instead refer the media to your FOX station representative. Additional restrictions may apply.
RELEASES: Selected FOX VIP will be required to complete a signed declaration of eligibility, acknowledgement and liability/publicity release form in order to undertake role as FOX VIP. Selected FOX VIP may be required to execute additional releases or documents in order to participate in the FOX VIP program. Selected FOX VIP is responsible for all taxes associated with the incentives offered. Incentives may be considered income and taxes on said incentives are solely the responsibility of the selected FOX VIP. Compliance with all regulations is the responsibility of the selected FOX VIP. By participating in this program, you agree to release the FOX Network and FOX 50 (WRAZ-TV)/Capitol Broadcasting Company, Inc., each of their sponsors, advertising and promotion agencies from any and all liability for claims, actions or proceedings for injuries or damages sustained in connection with your participation in any FOX VIP activities and/or events, and ownership or use of any materials and/or products provided by FOX Network or FOX 50 (WRAZ-TV)/Capitol Broadcasting Company Inc., or while traveling to, preparing for or participating in any FOX VIP-related activity. Except where prohibited, by participating, participants have granted FOX Network and FOX 50 (WRAZ-TV)/Capitol Broadcasting Company, Inc. the right to publicize their name, photograph or likeness, voice and biographical details and have accepted and agreed to be bound by these terms and conditions.
LIABILITY: FOX 50 (WRAZ-TV)/Capitol Broadcasting Company, Inc., are not responsible for problems associated with television transmission, radio transmission, cable transmission, satellite transmission, phone lines, Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, or other Internet interruptions or malfunctions or for any technical or other difficulties which may prohibit, prevent, or interfere with the transmission of television or radio signals to all or limited geographic areas during the FOX VIP Talent Search or which may interfere with a participant's ability to login or register or submit an application/submission online, electrical outages, natural disasters or acts of man or God that are beyond the control of FOX 50 (WRAZ-TV)/Capitol Broadcasting Company, Inc. FOX 50 (WRAZ)/CAPITOL BROADCASTING COMPANY, INC., DISCLAIM ANY WARRANTY OF MERCHANTABILITY, WARRANTY OF FITNESS, AND ANY OTHER IMPLIED WARRANTY. FOX 50 (WRAZ-TV)/Capitol Broadcasting Company, Inc., are not responsible for cancellations, postponements, or delays.
Any attempt by an entrant or any other individual to damage any online service or web site or undermine the legitimate and fair operation of the FOX VIP Talent Search will disqualify the participant responsible and is a violation of criminal and civil laws and should such an attempt be made, FOX 50 (WRAZ-TV)/ Capitol Broadcasting Company, Inc. reserve the right to seek damages and/or other remedies from any such person to the full extent permitted by law.
All decisions relating to the FOX VIP Talent Search and interpretation of these terms and conditions are made by the management of FOX 50 (WRAZ-TV) in its sole discretion and are final. FOX 50 (WRAZ-TV) reserves the right to change the terms and conditions at any time to ensure the fair administration of the FOX VIP Talent Search and compliance with applicable laws.
